Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT WILL NOT INCREASE OR IMPROVE YOUR CHANCES OF WINNING.
1. ELIGIBILITY. The 2026 Mall of America “Primark Grand Opening Giveaway” (the “Sweepstakes”) is only open to entrants who, as of the entry date, are permanent legal residents of the fifty (50) United States or the District of Columbia who are at least eighteen (18) years old. The Sweepstakes is void outside the eligible Sweepstakes territory; and where prohibited or restricted by law. Employees, officers and directors of MOAC Mall Holdings LLC d/b/a Mall of America (“Sponsor”) and its respective parents, subsidiaries, affiliates, divisions, advertising and promotion agencies, and the immediate families (defined as parents, spouses, children, siblings, grandparents, and their respective spouses) or members of the same household (whether related or not) of each such employee, officer and director, are not eligible to enter. The Sweepstakes, and any website pages and advertisements relating thereto, are intended for viewing only within the eligible Sweepstakes territory, and entrants must be present in the eligible Sweepstakes territory at the time they enter.
2. TIMING. The Sweepstakes entry period begins at 10:00 a.m. Central Time (“CT”) on August 23, 2026, and ends at 11:59 p.m. CT on August 29, 2026 (the “Entry Period”). Sponsor’s computer is the official timekeeping device for the Sweepstakes.
HOW TO ENTER. There is only one (1) way to enter the Sweepstakes as described below. Entrants must enter the Sweepstakes by: (1) Follow @mallofamerica and @primark (2) like the @mallofamerica [Primark Grand Opening Giveaway] post via Instagram and (3) comment under the @mallofamerica [Primark Grand Opening Giveaway] post via Instagram. By liking and commenting under this post in accordance with these instructions, you represent that you have complied with the submission guidelines and content restrictions specified here. Any sharing must include #MOA Sweepstakes. The Instagram comment may not contain: 1) information that is deemed to be obscene or lewd; 2) material that violates or infringes another’s rights, including privacy, publicity, or intellectual property; 3) material that is hateful or defamatory; or 4) material that is unlawful or in violation of or contrary to the laws or regulations in any state. You must not inaccurately tag content or encourage others to inaccurately tag content. Submissions containing such prohibited content and/or otherwise deemed by Sponsor, in its sole discretion, to be inappropriate will be disqualified. All entries will be held until the Entry Period is over and discarded after the winner has been confirmed. All entries will be deemed to have been made by the authorized account holder. Submitting mass entries, multiple entries, or entries generated by a script, macro or use of automated devices is prohibited and may result in disqualification.
To enter, you must have a non-private Instagram account to participate in and enter this Sweepstakes. If you do not have an Instagram account you may download the free application on your mobile device. Please note that you must agree to comply with the Instagram Terms of Service (Terms of Use | Instagram Help Center) and Privacy Policy (Meta Privacy Policy) in order to create your Instagram account. If your Instagram account is private, your Sweepstakes submission will not be eligible. Once you have such an account, you must become a follower of @mallofamerica and @primark. It is free to follow @mallofamerica and @primark on Instagram. If you have an Instagram account and are not already a follower of the @mallofamerica account, then you may log onto Instagram using your Instagram user name and password, and then may become a follower of @mallofamerica by going to Mall of America (@mallofamerica) • Instagram photos and videos and clicking the “Follow” button. If you have an Instagram account and are not already a follower of the @primark account, then you may log onto Instagram using your Instagram user name and password, and then may become a follower of @primark by going to Primark (@primark) • Instagram photos and videos and clicking the “Follow” button. You must follow @mallofamerica and @primark throughout the Entry Period and for at least five (5) days thereafter (for potential notification purposes) to participate in the Sweepstakes and be eligible to win. You may unfollow @mallofamerica and @primark after the five (5) day notification period.
All entries must comply with the Instagram Terms of Service and Instagram Rules available at the Instagram web site. If you opt to use Instagram via your wireless mobile device, standard text messaging and/or data rates may apply for each message sent or received from your handset according to the terms and conditions of your service agreement with your wireless carrier. The Sponsor(s) is not responsible for charges you may incur as a result of wireless phone transmissions. Entrants acknowledge that messages are distributed and delivered through third-party providers. Sponsor(s) do not guarantee, and shall not be responsible for, the delivery or timeliness of any Instagram entry. Sponsor(s) will at all times consider the time that a message is logged as received in its system as being the time of a Instagram entry, regardless of the time at which the Entrant attempted to send the entry and regardless of any technical problems or other complications that may have delayed its delivery. By submitting your entry in accordance with the Official Rules, you (and your parent and legal guardian) represent that you have complied with and agree to these Official Rules and the submission guidelines. All entries will be deemed to have been made by the authorized account holder for the Instagram account. False or deceptive acts, as determined by Sponsor(s), will render the entrant ineligible. LIMIT: One (1) entry per eligible entrant/Instagram account in this Sweepstakes.
4. WINNER NOTIFICATION/REQUIREMENTS: One (1) potential prize winner will be notified by @mallofamerica via direct message to the potential prize winner’s Instagram account on or about August 31, 2026. The potential prize winner (and a minor entrant’s parent or legal guardian) will be required to sign and return to Sponsor within forty-eight (48) hours of initial prize notification an Affidavit of Eligibility, General Release & Waiver, and Publicity Release (“Affidavit/Release”) in the form or forms provided by Sponsor (where and to the extent legally permissible) at the time prize is claimed up in order to be eligible to claim the Prize. A prize must be claimed at the place and manner as directed by Sponsor in the prize notification, or the prize may be forfeited. If not disqualified, the potential prize winner (and a minor entrant’s parent or legal guardian) must continue to comply with all terms and conditions of these Official Rules, and winning and awarding of the prize is contingent upon fulfilling all requirements. If a potential winner cannot be contacted directly by Sponsor and/or does not acknowledge notification from Sponsor as required above within twenty-four (24) hours of the first attempt to contact the entrant, or if a potential winner (or a minor winner’s parent or legal guardian) fails to return the Affidavit/Release within the specified time, or if any prize or prize notification is returned as undeliverable, or if a potential winner is found to be ineligible, or if a potential winner (or a minor winner’s parent or legal guardian) does not comply with the Official Rules, then the potential winner may be disqualified and an alternate winner selected by Sponsor in his/her place at random from among all eligible non-winning entries received by Sponsor. In such event, an alternate potential prize winner will be notified as described above and will be required to return the documents to Sponsor as described above; provided, however, Sponsor may alter the above timing to meet its Sweepstakes schedule. In the event of disqualification of a potential winner, Sponsor will make a reasonable attempt to contact alternate winners as described above; provided, however, Sponsor reserves the right to discontinue such efforts in its discretion and not award the prize. Sponsor is not responsible for the failure of a potential winner (or a minor potential winner’s parent or legal guardian) to receive any of Sponsor’s notifications or documents for any reason, or for the inability of a potential winner (or a minor potential winner’s parent or legal guardian) to respond to any of Sponsor’s notifications or return any required documents for any reason. Eligibility, age, and other claims of/information provided by a potential prize winner are subject to verification by Sponsor or a prize supplier. Entrants (and parents and legal guardian’s of minor entrants) must cooperate with Sponsor, a prize supplier, or their respective representatives in connection with any and all verification activities.
5. AGREEMENT TO OFFICIAL RULES AND DECISIONS. By participating in the Sweepstakes, each entrant (and a minor entrant’s parent and legal guardian on behalf of the parent or legal guardian and on behalf of the minor entrant) fully and unconditionally agrees to be bound by and accepts these Official Rules and the decisions of Sponsor (including, without limitation, decisions regarding eligibility of entries, the selection of entrants and the winner, and the awarding of the prize), which are final and binding in all respects.
6. PRIZE. Subject to the terms and conditions of these Official Rules, One (1) prize will be awarded in this Sweepstakes. The prize consists of and is limited to the following:
- one (1) $250.00 Primark gift card, with a total approximate retail value (“ARV”) of $250.00; and
- the opportunity to skip the line on Primark at Mall of America’s opening day and attend the ribbon cutting ceremony in the store (ARV $0.00)
Total ARV of the prize is $250.00. Gift cards are subject to the terms, conditions, limitations and restrictions of the issuer thereof.
Prize is nontransferable, nonassignable, nonnegotiable, and not redeemable for cash or credit. Prize must be accepted as awarded. Prize is awarded “AS IS” with no warranty, representation, or guarantee, express or implied, in fact or in law, made by Sponsor or for which Sponsor shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. No prize substitutions, except by Sponsor; Sponsor reserves the right (but has no obligation) to substitute a prize (or a component thereof) with another prize of equal or greater value (including cash) if the prize (or a component thereof) is not available for any reason as determined by Sponsor in its sole discretion. Unused components of a prize shall be forfeited and have no redeemable cash value. Winner (and the parent or legal guardian of a minor winner) is solely and fully responsible for any and all costs, fees, taxes, assessments and expenses associated with prize awards, redemptions, receipts and uses, including, without limitation, all federal, state and local taxes on the prizes. If applicable, a winner (or a minor winner’s parent or legal guardian) will be issued an IRS Form 1099 for the actual retail value of the prize. The winner (and a minor winner’s parent or legal guardian) waives the right to assert as a cost of winning a prize any and all costs of verification and redemption or travel to claim or redeem the prize. If a winner is a minor in his/her jurisdiction of primary residence, the prize may be awarded to the minor’s parent or legal guardian who must assume all responsibilities of the prize winner. Non-compliance with any of the foregoing and any other condition of this Sweepstakes may result in disqualification and forfeiture of prize, in which case, no consideration will be awarded.
7. PUBLICITY. Except where prohibited by law, participation in the Sweepstakes constitutes a winner’s (and a minor winner’s parent’s or legal guardian’s) consent to Sponsor’s (and its designees’, successors’ and assigns’) use of winner’s name, biography, likeness, voice, photographs, video, opinions, statements, hometown, state and country for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration, attribution, notice, review or consent.
8. GENERAL CONDITIONS. Sponsor reserves the right, in its sole discretion, to terminate, modify or suspend the Sweepstakes if, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if viruses, bugs, unauthorized intervention, fraud, technical difficulties or failures or any other factor corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, as determined by Sponsor. In such event, Sponsor reserves the right (but does not have the obligation) in its sole discretion to award any prize at random in a manner determined to be fair in Sponsor’s sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision or any other provision of these Official Rules.
9. RELEASE. By entering and participating in the Sweepstakes, each entrant (and the minor entrant’s parents and legal guardians) forever and irrevocably releases and holds harmless Sponsor and its parents, subsidiaries and affiliates, and their respective agents, designees, advertising and promotion agencies, affiliates, Sweepstakes partners and prize suppliers, including, without limitation Mall of America tenants, and all of their respective employees, officers, directors, shareholders and agents from and against all claims, damages or liabilities arising in whole or in part, directly or indirectly, from entrant’s participation and/or entry in the Sweepstakes or any Sweepstakes activities, and/or entrant’s award, redemption, receipt or use of any prize awarded in the Sweepstakes. This Promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta. By participating, each entrant completely releases Instagram and Meta from any and all liability related to this Promotion
10. LIMITATIONS OF LIABILITY. Sponsor is not responsible for (a) unauthorized intervention in any part of the entry or redemption process or the Sweepstakes; (b) printing, typographical, electronic or human errors which may occur in the offer or administration of the Sweepstakes; or (c) any injury or damage to persons or property, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes.
11. ERRORS AND TAMPERING. Sponsor is not responsible or liable for printing, typographical, electronic or human errors, or tampering which may occur in the offer or administration of this Sweepstakes.
12. DISPUTES. Entrant (and a minor entrant’s parent or legal guardian) agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded or to be awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in federal or state courts located in Hennepin County, Minnesota; entrant submits to sole and exclusive personal jurisdiction to said courts in the State of Minnesota for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will entrant (or a minor entrant’s parent or legal guardian) be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant (and a minor entrant’s parent or legal guardian) or Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Minnesota, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota.
13. DATA COLLECTION. Entrants may provide personal information to Sponsor and its designees in connection with this Sweepstakes. For more information about the ways Sponsor uses and shares personal information, please see the Privacy Policy of Sponsor located at https://mallofamerica.com/privacy. In the event of any conflict between the Privacy Policy and these Official Rules, these Official Rules shall govern.

15. WINNER’S LIST.
